الأقباط وسؤال المواطنة-4

السؤال الخامس
ما هو الموقف من قضية النص الدستوري الخاص بأن الشريعة الإسلامية مصدر التشريع في مصر؟ هل يمثل عائقًا أم عاملاً مساعدًا للانضمام والاندماج في الحراك السياسي الحالي؟
-هذه القضية مهمة وحساسة، ويهمنا هنا نقطتان
النقطة الأولى: تتعلق بطريقة عرض القضية على المجتمع؛ فمن ناحية يقفز البعض من قضية مناقشة نص دستوري إلى قضية رفض الشريعة الإسلامية، ومن ثم يخلط هذا بذاك، ومثالا على ذلك ما قرأته على موقع "إسلام أون لاين.نت" للدكتور "رفيق حبيب"، حين تحدث عن رغبة بعض الأقباط المدعومين من الخارج ومريديهم في الداخل إلغاء المادتين الأولى والثانية من الدستور، ثم قفز لاستنتاج أنهم يقعون في خانة "المستعدين للخارج على ثوابت الأمة".
وخطورة مثل هذا الكلام أنه يعني أن أي شخص يتحدث عن مواد في الدستور صادف أن لاقت قبولا لدى تيار سياسي محدد يدخل في باب العمالة للأجنبي وخيانة الأمة، وهي اتهامات خطيرة، ولا تطول الأقباط فقط وإنما تطول كل من يتعرض للدستور بالنقد والتحليل.
وفي حالتنا هذه تم وضع الأقباط في خانة الخيانة، وأضيف من عندي -طبقا لطريقة الدكتور "رفيق"- العلمانيين المصريين الذين يرفضون أن يكون للدولة دين؛ لسبب أن الدولة لا تقوم بالعبادات، وإنما هي نظام مؤسسي لتيسير أمور الناس؛ فكيف يكون لها دين؟ وهنا يقترح البعض -وأنا أوافقهم- النص بأن دين غالبية الشعب المصري هو الإسلام، وينبغي أن يراعى ذلك في التشريع؛ فهل دخلتُ هنا في زمرة الخائنين والعملاء؟
إن مشكلة عرض تطبيق الشريعة الإسلامية تكمن في عارضيها؛ فما رشح من المتصدرين لتطبيقها هو دعاوى حسبة لتفريق الأزواج، وحديث دائم عن الحدود، ومصادرة أعمال أدبية وفكرية، وذلك على الرغم من أن هناك اجتهادات فكرية إنسانية راقية في مجالات الحقوق والعدل والأخلاق الإنسانية لمجموعة من المفكرين الكبار، مثل المستشار طارق البشري، والأستاذ سليم العوا، والدكتور أحمد كمال أبو المجد وغيرهم. وتقديري أنه حتى الآن لم تحل مشكلة الشريعة الإسلامية وقيام الدولة الحديثة، وأنا هنا أتفق مع ما كتبه الأستاذ عبد الرحمن الحاج على موقعكم منذ شهور حول "الدولة في الفكر الإسلامي".

النقطة الثانية: تتعلق بالدستور؛ لأننا إذا اتفقنا على أن الدستور يمثل النص المتفق عليه بين أفراد الشعب وفئاته تعبيرا عن عقد اجتماعي، وليس نصًّا مفروضًا على الشعب ممن يظن أنه الأعلم والأتقى؛ لأصبح لدينا إطار حاكم نتحدث فيه. ومن ثم نترك لجمعية وطنية تأسيسية البت في الأمر.
من ناحية أخرى، ونتيجة لطريقة عرض موقع الشريعة الإسلامية من القانون أضر المتحمسون دون أن يدروا بموقع الحضارة الإسلامية والعربية في وجدان الكثيرين.. أليس من المستغرب أن يترك التركيز على الجامع الثقافي والحضاري العربي الإسلامي، ويتم التركيز على المفرق الديني؟.
يا سيدي، الجامع الأزهر بالنسبة لي هو عبقرية حضارية أفخر بأنني جزء منها، وأنها جزء من تراثي الحضاري.. أليس هو كذلك بالنسبة لك؟ بل إذا زدت أنه لك مسجد أقول لك: هو لي ملهم بالروحانية، وجلال الذات الإلهية.

Dear, this is exactlly the problem and I think we must act on different levels, philosphical/thioretical, historical/sociological (as you metioned who said that copts are tributary group within Egyptian Society)and then Advocacy and struggle for eductional reformation towards reason and science

I hope it be an answer to the so many questions facing us.

I will have to agree that there is a problem with looking into Copts as
a "minority" cause they are not.
History tell us that we have lived as one nation for 1400 years peacfully and that is a record that even western democracies who scream about human rights day and night do not have.
I beleive that there is an underlaying agreeement on the equal rights and duties of citizenship regardless of religion among the majority of the political forces on the Egyptian scene, the Brotherhood included.
I find it problamatic when some try to interpolate a certain instant of application of Shariaa in
a different place and time and use it to scare people. Each time and
place has its own unique circumstances

On the other hand, Egyptians who happen to be copts need to come out and have a stronger participation in civil live, dialogue with others, specially those who carry different points of views and do not be scared. They have that responsibility towards the
country and society.
Diversity of opinions is a value that we all need to learn in Egypt.
